I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays.This is my understanding.
Same thing at Indian consulates. I

thanks gcwaiting!!! I was so worried, my attorney told me that I onlyhad 45 days, maybe he wanted his payment in 45 days......
This is to complicated and INS take a lot of time to respond....By the way do you know aproximately how long will take to receive the I-140 approval? And if there is a chance to receive a DENIED notice? I'm so wooried about all this process and alo because I don't have the best attorney in th all world, and sometimes I don't know what to do...I'm learning a lot fom this forums. Thanks Again....

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.
Short answer is NO.
You have to file a new PERM and it will be processed in the existing processing times unless its a special handling case (University profs, etc) which currently is taking around 4 months to get a PERM approval.

I-140 approved. I haven't applied for I-140 yet.
I am looking to move to different position with similar job responsibilities within my company.
I spoke to company's internal legal dept - and as per them they would require -
a) My current job responsibilty as filed on GC app
b) New Job responsibilties from new manager
c) A note from new manager stating that new job responsibilities are similar to current one.
With this documentation, I could use my existing I-140 & don't have to file for H1-B, labor & I-140 again.
Do I need to be concerned for anything else?

My wife's H1 ends and before it expires she is leaving for home country, there she will apply for h4 to come back on.
Do we need to file change of status form for her?

as long as she is in US she is on H1
in home country She gets H4 stamp..When she enters US again she gets H4 status..

Hi,
A consultancy firm applied for my H1b Visa this year (2009). USCIS has denied the visa showing the reasons like:
1) My manager (CEO of the company) and the person I will work under (From the client company) is different.
2) They questioned in same line about the place of my work.(office of the firm and the client).
3) They have some points regarding wages of previously employed H1bs of the firm.
There's no point however about my qualification and experience (I have a degree from IIT and work at India branch of one US multinational). The company says that they have a number of approvals this year and the particular decision depends on the officer at USCIS to a large extend. They can re-appeal addressing all the concerns mentioned by USCIS.
How much are the chances are that a denial would be converted to approval. Is the USCIS going to be very strict and judgmental about the re-appeal of the denial?. May be it is hard to tell, by I greatly appreciate any help/suggestion...

We know we have our largest membership in CA. Well over a hundred members. Yet there are only about 10 active members. And yes, these 10 are extraordinarily dynamic, but we need more. In particular we need more members in SoCal.
Those of you who have already signed up as volunteers -- please attend the weekly call this Thursday at 9pm PST. Once you are on the call, please speak up, take the initiative and work on something.
Respond to the weekly emails.
- Convince at least one more person to become a member
- Convince at least one more person to contribute
- Post our flyers in your neighborhood or workplace
- Come up with other ways to get the word out
- Join a lawmaker team
- Start a lawmaker team and make an appointment

Hello, All buddies:
My case is a little special:
After my wife (H-1B) filed I-140/I-485, I got EAD in Dec 2006, and I (H4)started to work by using EAD from Jan 2, 2007. On May 10, 2007, we received I-140/I485 denial letter. we filed a reopen and reconsideration for I-140 denial. I was still using that EAD for work (it is vaild from Dec 2006-Dec 2007) during that time. In November 27. 2007, I changed my visa from H4=>H1.(I was not being asked by USCIS to go aborad for re-stamping H1, anyway it is approved). The USCIS denied our Reopen and Reconsideration for I-140 again later in March 2008.
Now the comany sponsor me to apply for EB2 green card.
Usaually, when using EAD, your status is AOS, and when I-140/I485 denied,
you lose your status. In my case, from May 10-Nov 27, I maybe already lose
my status. however, H4=>H1 is OK without any problem.
My question
1.
I worried that in the future, in the stage of waiting for I-485 approval, does USCIS can find out that I have the above problem between May 10-Nov 27, (it is over 180 days)?!
--However, during that period, I have a I-140 reopen and reconsideration case pending?--does this mean legally staying in US? (even it denied again later)
2.
If this is a problem, do I had better go home country/re-entry US once to clean these mess?
3.
However, I am over 180 days, is that possible that I can not come back?

USCIS had been given strict guidelines to process all cases within a six month timeframe depending on the type of the case. But many cases have come to light which are not seeing the light of the day.
How about filing our taxes on April 16, but not on April 15.
Exactly what is your logic? There is no law against their getting delayed in completing a case in 6 months. There is a law for not submitting taxes on time. That is why I think this argument is not very valid. I can see your frustration with the delays at USCIS, however, and sympathize with it.

Also, when would the next years quota become available and when can one start working at the earliest ?
