Hi,
My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree in MIS or Computer Science or EEE.
Can we reject the candidate saying, doesn't have required bachelors Degree in above mentioned 3 fields, and not having enough experiance in one of the specified skill set?
And also do we need to do interview candidates before rejecting?

After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

USCIS will be interested in the content of the application rather than the reputation of the attorney submitting it. You are free to submit your own application if you are comfortable researching immigration laws required for your application.

Donate 1 million dollars to USCIS, they will come to your house to handover the card. I believe that is the only way you can expedite, as for as I know.

I don't think F-1 is dual intent. F-1 is non-immigrant visa. Dual intent means, even though the visa it self is non-immigrant but it has intent to change to immigrant visa, such as H-1B Temporary worker and K-1 Fiance visa.

I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait?
See visa bulletin. Your case is Family Based (FB) 2A. Currently, it is at 01APR06 (i.e., the applications that USCIS received before 04/01/2006 are eligible to be approved). You need to study how quickly the dates move by going through VISA bulletins in the last 3-4 years, but my guess would be about 5 years.

while applying, is it true that my wife can't enter the US?
AFAIK, not on the basis of her GC application, but if she gets another (dual-intent) VISA, say H1B, then she can enter US.

1) Bank deposit in US around 9000 $
2) deposit in india about 10000$
3) Job No objection certificate ( parents )
4) affidavit's of support
5) They carried all property documents in india ( valuated by CPA )
6) my H1b1 copy and a letter of invitation from me

i got a call from my employer stating that my 45 days later has coem (whether i want to continue with the green card process or not)
i called my lawyer to find out if the pepers have arrived which i need to sing and get signed from my employer and return ..and she has nto recived them
wat do we do now?
can we ask for another copy and how tp go about thsi process?

If you are going to Nogales after 7th year extension, even if you get 3 years of h1, Nogales consulate gives visa for 1 year.
I have talked to Visa Officer he refused to give me for 3 years and he told me that it is the policy of Nogales consulate.

few days ago, I tried to extend H4 visa for my spouse but I heard through one of the lawyer in the firm that once H4 visa holder used EAD, H4 becames invalid unless you enter again in POE using H4, we cant apply for H4 extension as the current status is AOS. But we are still exploring it.
I checked in H4 extension form I-539, they ask:
1. current immigration status?
2. whether you want to extend current status or change of status?
But my spouse is working so if we say change status to H4 from AOS then not sure whether she can use immediately EAD to work? I opened a thread regarding this.

Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is
1.will that affect my H1-b transfer?
2.will USCIS go back that far to verify my paystubs?, and
Please Please Please reply , if possible any attorneys

I have the following situation, any help/pointers is much appreciated:
- Have EAD (expired Sep 2010). H1B expires Dec 20, 2009.
- I was informed sometime back that I am going to be laid off mid September (next week)
- I am expecting another job offer (interview went well and most likely will get the job) and plan to start at that job late September / eraly October 2009.
- The new offer that I am expecting to get is for the position of Senior Software Engineer, whereas my previous position (where I will be laid off from) was Software Engineer.
So, my questions are:
1. Is it still possible to transfer my H1B visa even though I expect a gap of atleast 2 weeks between the two jobs, or is it better to switch over to the EAD?
2. Will it be a problem for my pending 485 application if my position changes to Senior Software Engr? (although the responsibilities in both positions are about 95% similar, few more responsibilities as a Senior Eng, thats all)
3. If I end up changing over to EAD, what next steps should I do (wrt keeping my 485 applicationb alive and to inform USCIS that I have switched over to EAD).
4. A few months before I got the notice of layoff, I got engaged to a woman in India. I would have preferred to get married by end of the year (would have applied for 1yr extension of H1b) so that my wife could have come over on H4 visa. Now, if I switch over to EAD, what are the options of bringing my (to be) wife over? Is this going to be a problem?

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.
I think I wasnt clear with my 1st post.
A different employer has file my labor. I do not want to file a new GC with my current employer. New employer is saying that H1 wont be transferred without client letter.

There is just one other way that you apply for citizenship , get it and then sponser them for GC again but that whole process would take a year at least and money too.
Best thing would be to wait . I am sure that EB3 India would move by a couple of months in this year and your family would get the GC's. If you have waited for the last 8 years for them , another few months should not matter.
Going the citizenship route is probably going to take longer in your case I think . You can try that if EB3 doesn't move in the next six months.
