Hi All,
Me and my wife are on EAD. We want to open LLC. Right now I am doing consulting in IT firm. My wife is not working anywhere. What are TAX and immigration consequences if we open LLC on my wife's name?
Questions we have..
1. Can I become parnter easily once my status got changed from EAD to GC?
2. Once my wife start LLC, can she work for another company e.g. Software consulting?
3. What would be tax bracket for my owner of LLC?

You can start LLC or 'C' corp on EAD. No consequences. You cannot start 'S' corp on EAD. See this:

Hi,

* They filed for an EB-3 Labor Certification (RIR) and I-140 with a priority date of April 2003 on my behalf.
* My H1-B expired in March 2006 and they filed for a 3-year extension, which was approved (till March 2009).
* In the meantime, both my Labor and I-140 were approved. I had been waiting to apply for my I-485 since then.
* Now, I'm switching employers (because of a RIF in company X) to company Y, who were working on making me an offer.
* However, company Y's legal department came back saying that they cannot apply for an H1-B transfer because the current law doesn't allow transfers from an H1-B extension (after the original 6-year H1-B has expired).
Could somebody advise me if this is really true?

Hi All
I worked for a company A till July 2006. Company A had applied for my Green Card using RIR process. I got my Labor certification approved and company A applied for I-140.
In August 2006 company B acquired company A. Company B moved me to a different physical location and different state.
Company B amended my I-140 application filed by Company A to preserve the priority date. Now company B is planning to file I-485 for this ongoing I-140 application.
My Questions:
Is there any risk for I-140 application since company B amended I-140 application filed by Company A?

Dont we need to go to the home country for transfering from H4 to F1? Can we do it by staying in the US itself?

You need to go your home country, if you want to get the visa stamped. Here you can apply for change of status to F1. In fact as you are member of Immigrationvoice, so most likely you have applied for green card. In such case you should not go home country to apply for F1. It could be problematic. The consular officer might even reject your F1 .

In my opinion, one of the more intriguing product announcements from Nikon today was the Coolpix 8700. If it improves significantly from the Sony, that could be a killer product. Right now, Canon is lacking a bit in the true consumer DSLR market. But then again, PMA is right around the corner. I agree with the post above.
I think the best option he has is to speak with the CBP officer at the port of entry and explain him the situation: that he wanted to use automatic visa revalidation and by mistake he surrendered I 94. Hopefully he will issue a new I 94 for him. But more likely he will ask him to go to the consulate and get the new stamp.
What he should NOT do is: to enter on the attached I 94 on H1 visa extension approval (the reason is technical: usually the I 94 that comes attached with change of status has the SAME number as your old I 94 attached to passport; so for practical pusposes, he has surrender both his I 94s). If he now enters with the I94 attached with H1 approval, (and as that is already cancelled when he surrendered other I 94), he will be considered present illegally. This would have much worse consequencies than to wait in Torronto and get the visa stamped.

Hello everyone,
According to my immigration-lawyer, I have received a notice for interview. I filed under EB2 category and only my and my wife's I-485 is pending. I had friends who got their GC without the interview, but i got called of an interview, so I was wondering why i got called for an interview-any specific reasons that some of us get called for an interview?
Another questions is; i read some blogs and almost all the people who were called for an interview seem to get a list of documents from the INS to take along for the interview. My attorney didnot mention anything about the list, so do all interview notices come with the document list or is it normal to not have one?
Please any insight in this matter would be greatly appreciated.

My husband and I are working on H1B visa.My husband has filed for Green card..
Now my question is at what stage in my husdband's Green card process, will I be eligible for the visa extension
if 6 years on H1B are over??
If I also file for the green card, I get labor cleared and just in case I lose the job.Then what options I have
for visa extension?If I join another company do I have to have again labor cleared to get additional visa extension
at the completion of 6 year?what happens to priority date,can I use earlier GC filing priority date?

You can reply to the RFE exactly as you stated. That your wife and child are abroad and will be applying for visas at the U.S. post to accompany you, therefore they do not have A numbers or receipt numbers.
You must file I-824s for them if you have not already done so.

It turns out that it was the photos. I had already sent it. So, don't know why they are asking again. I am resending the photos now. I had a question. Though it is simple, I don't want to take any chances as we are planning a travel soon. They have asked me to write my name and Alien number on the back of the photo in pencil or felt pen. I tried writing using a pencil and it is not readable. So, what is a felt pen ? Is the idea here that whatever is written on the back of the photo should not leave an impression on the front of the photo. Thanks for your response.

So guys just off the phone with a very decent IO at NSC . talked to her 30 mins, yes you are right 30 mins..which is unheard off..
the questions that I asked were very simple

Q2: But, Maam, I wanted to know where my case stands as people with PDs and RDs later than mine (mine is March 2006 and July 26 2007) are being adjudicated
A2: Well, we cannot disclose anybody else's case, but each case is different, so we dont know
Q3: Okay, but can u tell me if my namecheck has been cleared (although i checked a week back and another IO told me it was cleared)
A3: No, for privacy purposes we cannot disclose this info
Q4: Okay then can you tell me why there was a LUD on my approved I40 on 7/13. (guess there were lots of us who had this)
A4: Yes, I can tell you that, what is your Receipt number
Q5. Here is my recpt number
A5: Okay it looks like your I140 was filed at Texas and they sent the file over to us. we consolidated that with your I485
Q6: Does that mean that my case is being worked upon
A6: No it does not mean that. This step is one of many many steps that are required for 485 processing. so this will not tell you anything
Q7: Is my case assigned to a IO
A7: No we cannot give this info, and even if you have this info, it is useless info as the center is going towards Backlog.
Q8: Then what is the meaning of processing dates as issued by USCIS
A8: They dont mean much,. they are just a gestimation of where things stand, and as off now the centers are facing backlog. there is lot of restructuring going on within the centers. The place to check is on the website., any change will be reflected there and it is upto date.
This was the gist of my call with the IO today.. w
What is the bottom line?
Sit tight and things will move only when USCIS wants.. nothing will happen otherwise..

I was little worried about filing AC21 when I am just 4 months away from GC. Filing AC21 with my current situation would not bother my GC then I am very much happy to switch over...Thanks everyone.

You can email to E-Filing.Support@dhs.gov requesting the receipt notice in pdf format. I had the same situation and i emailed the above Id and got receipt notice (pdf) in 48hrs. BTW in the email give your receipt number.

Very useful info. But it seems that "beautifulMind" does not have receipt number. Best thing would be to wait. Finding out whether payment is received in USCIS or not will be helpful (e.g calling credit card company).
One more thing, now a days USCIS started taking more than a week for sending confirmation or FP notice. This may be due to more work load or intentional delay due to multi-year EAD.
