Can someone clarify to our needy members the difference between employment verification letter and employment offer letter please try to understand EVL is not neccesary if you can produce latest payslips from the Employer who sponsored your GC but employment offer letter is very important from the same Employer who sponsored your GC.
Where is anything said about an offer letter/ payslips?

I had similar problem with United last year. I was flying thruogh Malaysian airlines and United charged me for extra 20 LBs. But it was checked in till India.
Delta is more helpful that way, one of my friends family had separate tickets on Delta and Malaysian, but the delta checkin guy checked in for both flights upto India, and even allowed the 70lbs on the delta part of the flight.

I agree. Who or which department of USCIS has the authority to decide they will disallow concurrent 140/485 filing? If that department has the authority to make such a decision they probably have the authority to
1. allow filing of 485 without visa number availability,
2. allow people to start thaie name check process once 140 is cleared and everyone is waiting for priority dates to become current.
There should be a way to find out who in USCIS comes up with these new rule suggestions. Where do all the proposed rule changes published? at the USCIS press release? May the actual press release has some information. There has got be to a way to find out from either press department or someone who or what part of USCIS makes these suggestions and then may be we can make send them out auggestions.

Hi,
I feel that per country quota for EB green cards is ridiculous. A skilled worker from India and China has to wait for GC 10 years, whereas a person from ROW gets it in few years/months. I wish I had known all the delays/pains in GC processing before I started my career here. We should start an online petetion/a law suit to end this disciminatory quota and address it to President/all the congressman/all the media.
Simple questions in the online petition/law suit:
1) Do you think it is fair for a person from India/China to wait for 10 years whereas a person from other country gets it in few years?
2) When there is no per country quota in H1B visas, do you think it is fair to have it in EB visas?
3) Do you think it is fair to have the same quota for India/China compared to a small country?
4) Everyone is aware of the legal immigration problems here, atlease try to make it same for everyone.
Most of us are Ivy League or good college graduates and work in good companies. We can mention our names, school and company information in the petition. All those who don't agree with me, please dont respond.

There is no need to let USCIS know about changing job after 180 days of 485 filing. U should have offer / empl letter from the employer when your priority date becomes current.
Job title can be different but job duties must be similar.
Salary difference is ok but it should not be less than what is mentioned in labor certification.
In addition to this couple of my close friends got GC recently and they never notify USCIs about new job(AC 21).

Spillover happens quarterly, but the visas are allocated in the last quarter! This is because the retrogressed countries are allocated their regular quota every quarter and the extra visas must be allocated based on the priority date, irrespective of the country! It would be difficult to allocate in the earlier quarters to achieve this!

If they want to make money, they no need to say that abt 2 year EAD at all.
And also most of the EAD renewals are free of cost who filed after 30th June 30 2007.
man this is US...here prices of goods are jacked up and then a big SALE sign is posted on the front door....
Same for EAD...hey! will give u 2 year EADs, but only if your PD is not close...and then they make most of ours PDs close to the Cut off date..and Oops...now only 1 year EAD

I have seen this same footage months ago and to it don't look real, its cooked. Some facts there are just un-digestible like the gora guy will take job of a waiter immediately after working as senior exec. cmon market is not that bad unless he don't know anything else and don't have ability to get other similar job, then he should be fired anyways. and then that carlos guy, his dress up don't seems convincing that other execs will give me good response after presentation. its all cooked... showing 600k+ numbers are all bogus.

My Lawyer says there is no need of such letter to be included and filed my papers and confident about getting that approved. I'm much worried and don't know what to do If gets rejected.

What I am saying is spill over from ROW goes to EB2 first. It does not split to EB2 and EB3 evenly. So more people from EB2 gets visa granted and thus people who joined EB2 bandwagon from EB3 and had earlier PD, they get Visa quickly. Now generally this spillover does not go to EB3 from EB2 having high demand from EB2 and thus EB3 get stuck with conventional numbers with 7% country limit and thus EB3 numbers move slowly. But if that spillover happens for both EB3 and 2 equally than EB3 can also move little bit quickly which is not the case. Thus shortening the queue by switching over to EB2 does not give full advantage to remained lot of EB3.

We have established that there is no document to support this but can we find out if this assumption can be true?
One can only infer based some facts and some assumptions.
Fact - Fallen new 485 demand (28% or more)
Fact - Law requires quarterly spillover.
Fact (?) - DoS allocated 30% of visas in Q1 (is it a fact?)
Fact - Dates did not move significantly
So all of these things fit together well only if one of the following is true

b) EB3 to EB2 conversion is substantial enough to not warrant any movement in dates.

We should think of taking some legal actions...
Ya..make sure you consult your attorney to know if such a thing is viable. :). Make sure you read the "employment at will" agreement along with all the other 28 pages that you will abide by the HR policies and also make sure that you read the 125 pages of HR policies.
