I am waiting for someone from IV core to endorse the idea.
Please contact IV core before you do these kind of campaigns.
I think that the IV core is aware of this campaign. They are not against it, as far as I understand, though obviously, there is no direct endorsement from them either.
I think this is a great idea to get media attention - something different and unique, and media always loves these things. The only thing that can doom it to failure is lack of enough numbers.
If we go and tell a journalist about this campaign, the first question we will be asked is, "how many flowers are you talking about?" and if our answer would 50 or 100, then the story dies right there. 250,000 affected skilled immigrants and only 100 of them are enthu enough to send flowers - well that's no story :rolleyes:.
So the only thing I can say is that at worst, this action will do you no harm and you will be out of 30-40 dollars. But at best, this can give us a media spotlight - and I think it is worth it.

Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass.
Why so? Because USCIS prime systems are not designed for huge volumes, or PD's so much in the waiting.

Hi,
My wife is in F-1 status, but I�m afraid to change to F-2 right now and loose the opportunity of transfer the H1 to a new employer... unluckily finding a job has not been an easy task, since I am in Puerto Rico and here the situation is not good.
My last paystub is June 14th, and I was wondering to apply on July 2nd, but because on delays with the medicals I got trapped in the Visa Bulletin fiasco mess.
I've talked with several local lawyers and none of them has given me hopes beyond the F-2 status.
Some friends recommended to file I485, but I don't want to risk for an RFE :(

VZLAN, have you explored the epossibility of a self sponsored petition? You have 10 years exp and a house/assets etc..you might be able to self-sponsor yourself based on these things. Look in google for 'self-sponsored green card'. There are people who do that and get through. You can do this in F2/F1 status too.

This does not mean we will not be seeing any approvals now. USICS might have assigned the visa numbers to lot of pending EB2 I-485 applications. They will be adjudicating those cases in few days. So folks keep the faith , keep bugging USCIS (call them day and night) and check immigrationvoice.org every 2 minutes and also don't forget to check your emails and uscis.gov website for CRIS updates every minute :eek:

Every week I take time to do some research so that I can be on top of the immigration updates, and why not?
Attorneys have absolutely no clue about the problems and despair we are going thru. They drag heels on simple processing and documentation work, oblivious to the fact that even a single day just adds to our woes.
I need to plan more than 6 months in advance for any major change in my life , be it marriage, having a baby, investing in property - u name it. Every single life event has a big question mark after it. Will I get the visa stamped? Will I be able to extend status? Can I do this, Can I do that? Well I guess life has an immigrant in the US (legal or illegal) has a question mark ?
I am going thru this frustrating non-ending wait to get anywhere close to permanent residency. I had filed for labor - Then came the DOL overhaul, where labor certification decisions are rolled out in the most haphazard, and random fashion one can ever imagine. Unable to wait any longer I even quit the company that filed my LC and joined another company
I am waiting for the new co to file a new LC under PERM - Again I need to wait as LCs can't be filed immediately for new hires - Even finding a co that can provide immigration benefits along with other personal benefits becomes a challenge.
Now I wish my old LC never gets approved - It remains pending for a few more years - at least I can get incremental h1b extensions. (thanks to the AC21 silver lining)
I just have another year left on my H1. I have worked for over 5 years legally, never going out of status, paying all taxes.

Hi,
We filed for my wife's H-1B under Masters Quota on April 30th and sent the application packet to Vermont Service Center. But on May 3rd UCSIS sent back the packet which we received on May 11th. They also sent a letter saying that the application be sent to Laguna Niguel (CA Service Center) instead.
Do you know if we can resend the application to Laguna Niguel now -- i.e., after the H-1B Master Cap is reached? If we can, then from which H-1B pool will USCIS issue the H-1B approval?
Has this happened to anyone before?

The concept of pre-approval/pre-adjudication have been practiced by USCIS since 2005. Though, it is not in their law or SOP or regulations, they are practicing now and before for ease of operation in processing the 485s. As per their current official rule, if a visa number is not immediatly available, the 485 shoul be kept in abayance (not to be processed) till VN again available. But practically it is not possible for them to follow. For example, suddenly, if DOS releases 60,000 visas in a month (like july 07 fiasco), they can not process and approve 60,000 485s in a month, if they keep those files in abayance. I think, they are still processing and pre-approving the 485s during retrogression. The concept of pre-approval in a silent internal procedure. They may pre-approve all the cases. However, they always has a right to check the applicant's eligibility for the approval of 485 at the date of approval of 485. One can not expect them not to send RFE/NOID after it is pre-approved. Unless the law changes drasticlly, it is not a easily achaivable benefit to introduce new immigrat status "pre-approved adjustment cases"for long waiting 485 folks. They clearly argue that benefit of AC21,EAD and AP itseltf a great benefit for 485 folks. There are only 3 immigrant catagory in the law. 1. Non-immingarts 2. Immigrants and 3. Pending to adjust status. Pending to adjust status it self a fluid temporary status as the stay in this status is autorized by attorney genreral. It is not a visa status like H1B or green card. In order to bring a new catagory in this status, I think they need to change the INA.

My wife got her name changed on the passport last week from the DC embassy. Her original Indian passport had only her first name and her last name was blank. Her US documents (Visa, SSN, Drivers License, etc) had her name as <first_name> FNU (Family Name Unknown). For a passport name change, the Indian Embassy requires you to:
1. Create an Affidivate in India saying that the name needs to be changed from <first_name> <blank> to <first_name> <last_name>.
2. Publish the name change in a national newspaper.
3. Publish the name change in a local US newspaper.
Along with the name change application, you have to submit the original affidivate, the paper clipings of the Indian newspaper and the local US newspaper.
Alternatively, if you have a marriage certificate and the marriage certificate lists your name as <first_name> <last_name> rather than <first_name> <blank> (as on your passport), you do not need the affidivate and a copy of the marriage certificate is sufficient.
The renew/change-passport-by-mail service that the indian embassy provides will take 10-12 business days (excluding Indian public holidays :) ). If you go in person to the consulate/embassy you can get your passport back within 3-5 days.
Atleast as far as I know, the DC embassy doesn't have any same-day service(don't take my word for that, I could be wrong). Good luck !

Jay,
You never cease to amaze me, impress me, and educate me.
You have taught me that this goes beyond just getting our green cards.
This is the difference between people that succeed in life and people that don't, people that bring change to the world and people that sit around hoping the world will change for them.
In you, and many others on IV, I see that kind of drive and motivation, and I hope to absorb some of that positive energy.
At times I have wondered why I do this, when most people that I know, who are in a similar situation don't. But I have always come out of that thought process with nothing but reaffirmation of my actions, and the intent to continue doing what I do, thanks to IV members like yourself.
I might get my green card in another year or so, but seeing the unwavering motivation and passion with which some people continue to challenge and change things that aren't right, makes me want to continue doing whatever little or large I can, to help them (and help myself in the process!).
My next destination after this thread, was this one.

Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.
So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh
And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. We will see what we can do� One thing I believe though is this country needs people with leadership skills and not so called "Highly Skilled". So I will be more than happy to work with you.
