My company filed an I-140 in December 2009. The petition (an EB2) was APPROVED in May 2010. A month or so later, I was laid off but BEFORE the I-485 was ever filed. As far as I know, the I-140 has not been revoked. What are my potential options here? Can I find a new employer to file a 485 provided the new job is similar to the I-140 petition or do they have to start the whole process again?
No...need to start the GC from scratch. You can not use your I140 as you no longer employed by the GC sponsor and can not use AC21 as I-485 was not filed.

Hi,
I am currently on an H1-B (and also have a I140 approved) with company A. I accepted a job with company B, who started the process for my H1-B transfer by filing the LCA.
My employment with company A ends 01/31, but company B has still not received the LCA approval. If they do not receive it before 01/31, will I be out of status until they file the H1B transfer? Do I need to leave the country?
Technically, yes you will be out of status starting 02/01 until H1B petition from your new employer is received by USCIS. Yes you should leave the country as from Feb 1 you will start accumulating unauthorized presence which might adversely impact your Green Card and other future petitions including the pending H1-B.
Practically if H1-B is filed within a week or so after 1/31 then it is up to you if you'll like to take a chance by staying in the country.

Looks like the demand data does not include the backlog at NVC. How does it work? I am not familiar with the process. Any ideas...?
Please see my earlier posting:
Here is the latest snapshot of the backlog of EB applications:
EB1= 7,595 + 2,961 ( at NVC) + new applications.
EB2= 45,573 + 6,738 ( at NVC) + Huge backlog waiting in line.
EB3= 114,442 + 102,395 ( at NVC) + unknown backlog waiting in line.
*NVC stands for National Visa Center.
** Does not include service centers.
* Spillover to EB3 may not happen for several years due to a large number of EB2's waiting to submit their 485 applications.
* Even if spillover occurs, majority of them will go to EB3 Philippines (please See the NVC backlog).
* From the above, assuming no spillover to EB3-I, it would take (56,640 + 20,873)/2600=30 years.
* With spillover (lets say after 5++ years due to the pending EB2s), it may take another 5 to 7 years to clear the EB3 backlog.

Please I beg you, did you purchase my labor? Did your company offered it
to keep you IN? Did your uncle/relative offered it to you...
I have a feeling that watermelons are sour...:D ( as some monkey quoted about legits)
Man/Woman I feel for you.....
In fact a mean and hopeless employer probably would not tell the original name on the LC to whomever he sells it.

Thank you for contacting me about the issue of immigration. I appreciate you sharing your views with me.
As you know, the United States Senate passed legislation earlier this year in response to the serious problems with our nation's immigration system. Debate on the comprehensive legislation dealt with a broad range of issues including our national security, border enforcement, guest worker programs, and the issue of immigrant workers in agriculture, seasonal jobs, and high-skilled positions. Our immigration system is broken, and I am well aware of the urgent need for reform and the impact on those trying to navigate this complicated bureaucracy. This legislation is now before the House of Representatives.
We need an effective immigration system that works for businesses and communities and that protects the basic rights of immigrants who are such an important part of our state economy and quality of life. In the end, I did not support this legislation because it failed to strike the proper balance between security, fairness and preserving Michigan jobs.
Thank you for contacting my office. I will keep your strong views in mind if the Senate considers this issue again. Please continue to keep me informed about issues that are important to you and your family.
Sincerely,
Debbie Stabenow
United States Senator
Above is what I received today in my mail.
I dont know what to do now. It seems that all our efforts are worthless. It seems that regardsless of what we do, the Senators have made up their minds about this bills. I think that anti immigration forces are way too stronger for us to tackle.......
I personally dont see any relief........

In that case may be for CP 22 Feb 2002 will be considered as cut off date & for AOS USCIS bulletin date will be considered. --
USCIS does not publish a different bulletin. Only the Dept. of State publishes the bulletin and this is used by both the embassies for CP cases and by USCIS for AOS cases.

I filed the Labor Certification since September, 07 and got audited in November, 07. The response was sent to DOL in November, 07. I have not heard anything since then. Also, my H1B visa expired in the early of May, 08. I left US on April 28, 08. Im very frustrated and depressed, and the lawyer is very unhelpful. I got questions as follows:
1) Should I refile the Labor Certification with my current employer in the new position? How about the audit? Should I request to DOL to withdraw the application first and refile the new one? Will my PD be changed according to the new filing date?
2) What would be the best way about H1B visa? I was out of US for one and a half month during these 6 years of H1B period. I heard that the vacation can be recapped, and I will be able to go back to US in the mid of July, 08 due to the pending PERM application for 365 days. In this case, should I start filing the H1B recapture with the H1 Extension now since my application will be pending for a year by the mid of July, 08 (include one and a half month times out of US). Otherwise, should I wait and start the application in the mid of July, 08?
3) If my Labor Certification is pending again till the end of one year extension (in the case of getting the approval on one year extension), do I have to leave US again?
4) I wonder if I should wait outside US for a year until the early of May, 09. Then, reapply the new 6 year- H1B visa again. Can my current employer do that for me? Would it be the better option comparing to the H1B recapture and H1B extension? In the case of starting the new application, when should I start the application? I heard the new H1B cap usually starts around the early of April and will be filled up within a couple days. Also, I have to wait for one year prior to applying for a new H1B, counting the day that my visa expired. So, does it mean that I have to wait till the early of May, 09 to be eligible to send the H1B application since the application will be rejected from USCIS in the case of submitting it prior to the early of May, 09 (one year rule)? Will the cap be filled up by then and what will I do?
Anybody, please advise. Thank you very much.

It is not clear to me why there is inconsistency on whatever they reply for the processing of NSC-->CSC-->NSC cases. Sometime I hear NSC mentions that these transfer cases would be processed based on CSC processing date (which doen't make sense because CSC stopped processing of I-485 caes, so how CSC processing date would move and the transferred case is waiting in NSC not in CSC) and sometime I hear NSC mentions those cases would be processed based on NSC processing date. Which one is actually true ?
I am wondering so far have we seen any approval from NSC for NSC-->CSC-->NSC transferred cases whose processing date RD/ND falls in 2007 (after the 2006 processing date of CSC).

I was browsing the jobs forum on craigslist and i was shocked to see some user urging people to call Senator Cornyn to not push H1 and Eb visa increases.
Of all places I least expected anti immigrants to be so active on craigslist.
Those who still have doubts about what we are against, let this be an eye opener.
And what are we doing? fighting each other? Wake up

Immediate Calls Needed to Stop H-1B Increase
Senator John Cornyn (R-TX) is leading an end-of-year effort to nearly double the importation of H-1B nonimmigrant foreign workers and to more than double the number of employment-based (EB) permanent residents admitted to the United States each year, among other things. This proposal would:
 Depress wages in high-skill occupations.
Force more highly-skilled American workers onto the unemployment rolls.
 Further erode Americas middle class.
Deter American children from pursuing degrees in high-tech fields.
Call the capitol switchboard at (202) 224-3121 or (877) 762-8762. Tell your Representative and Senators to oppose any H-1B increase. Who represents me?

Hmm, somebody can confirm this. I am in Houston, Texas
While I e-filed my EAD renewal, everything was super-duper and the pdf files indicate that it was sent to Texas Service Center (pending I-485 is in TSC and initial EADs/APs were received from TSC). I marked in my Application that My I-485 was Emplyment Based.
I went and followed the same steps for my wife's EAD renewal(She already received EAD/AP initially in October 2007, from the TSC), who is my "dependant", but marked hers as family based I-485. I think it is because of this anamoly that, the supporting documents is being directed to National Benefits Center.
Has anybody had a similar experience? Please share
I am planning to call USCIS tomorrow. I will update you all in the details.
My main concern now is
1. I do not want to send supporting documents to two places (so that they dont get confused)
2. I do not want National Benefits Center to realize that it is the wrong service center and transfer to TSC and delay the EAD's for my wife ( whose will expire sometime in October, 2008).
3. Since her I-485 is dependant on mine, i dont want them to think that her I-485 is now family and not "my employment"
