The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.
In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.

When I said "file is not opened", I meant that no one has yet reviewed the file. Note that for most cases PD is not a controlling factor. It is only the unfortunate ones from retrogressed countries that they have to wait for PD to be current. For everyone else, once file is reviewed, if all documentation is in order, case is cleared. Once a file is reviewed, if it has to wait for PD to be current, it is placed in sequence of PD. I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though

20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

50,000 unused visas were given to Schedule A in 2005. When the bill was first introduced the unused visas 100,000+ was supposed to go to EB3 since there was retrogression in just EB3 category and Schedule A was part of EB3.
After debate for a few days 50,000 of these were allocated to Schedule A and the EB3 retrogression was forgotten and never been fixed since.
Hope this doesn't happen again.
There are around 100,000 unused visas...am not sure if anyone takes UCSIS to court if these can be reallocated.

I see that the above discussion keeps on going on about EB-2 only. Doesn't anyone at IV care about EB-3 I also . I am sure there are a few EB-3 I people at IV who are suffering from retrogression , myself included.

How you handle these issues goes to the core character of the nation. Shooting 'intruders' is perhaps one way of looking at it. Then such a solution cannot be undertaken by a 'super-power' who wants to hold moral superiority in the league of nations.
A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? Please do not give a flippant reply, do think about it before you hit the submit button.
Socio-economic solution along with a sensible immigration policy has been found to be far more sensible as compared to a pure enforcement policy. It has been proved over the years that a pure enforcement policy which many nativists support to be economically unviable. Minutemen patrolling the borders to Gov. Perry's multi million dollar border cameras, have proven to be ineffective and economically unfeasible.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

I called uscis a couple of weeks agoand again today, I was told (by two different resp) that they go by Receipt date.
Yes, they go by the receipt date, which appears on your USCIS online status - they are suppose to go by the date delivered to mail room / receipt date printed on your 797

The July fiasco has led many of our members to get their EADs and has lulled them into false security. If your goal is just EAD, please continue with what you are doing but if your goal is to get green card or citizenship - NOW has to be your wake up call.

I have canceled 8/24 appointment and plan on taking appointment during first week of September. Los Angeles USCIS have plenty slot available, so taking it easy in taking appointment.

What irritates me the most about the GC backlog is not knowing exactly how many people are in line ahead of me.
We all know how many visas (without spillovers, etc.) are allocated to each country every year, but none of us knows exactly how many GC applications/PDs for each year are pending, which makes it extremely difficult to even semi-accurately predict when a certain PD will become current and stay current.
When I ask myself when I will get my GC, the answer is, "anywhere between the next month to the next 3 years", which is sad to say the least.
That being said, I commend the core team's efforts in pursuing this option.
I was looking at my paypal history and for some reason (problems with downloading history), was only able to see the $50 recurring contributions that I have made (I was on a $20 recurring contribution schedule before I started the $50, and I have made numerous, $50, $100 one time contributions during various funding drives) to IV, and that total was $1000 (20 months), I expect the total from all my contributions to be close to $2000.
It may sound like I am tooting my own horn, but the intention of this disclosure is to motivate other members to start contributing. There used to be a time when I felt that if I contributed, I would be the only one doing so, and things wouldn't go anywhere and I would end up wasting my money. Boy, was I wrong. There are thousands of members who contribute and it is because of the support of these very members that we have achieved what we have.
Hey, atleast this way, when I whine about the situation, no one can tell me that I should do something about it and not whine, because I have done something about it, I have contributed !!
