From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
If this law does not apply to existing labors, we will still be in the same situation. BTW, what is a desi company. How come it can sell labors? Is selling labor legal?

Point 1: We need to target news media here in the US primarily, not abroad. All good publicity is welcome, though. Please see a new thread started today by one of the moderators called "Ideas to increase Publicity of IV." There are key action items outlined there that every member can help out with.
Point 2: What will be shared (and with whom) will be decided soon by the core group. We used to send out regular updates, but that has suffered lately because we are all volunteers and some volunteers who were in charge of it are tied down with other things at work and home.
Point 3: We are already talking to people in academia and the academies.
Point 4: No member is "discounted." All are welcome, but we really need non-paying members to start chipping in money. What people decide to contribute is their business, and entirely theirs. Whether it is $20 or $50 or $100 or $500...that is entirely the call of the individual. This activity is not cheap, rather it requires a steady cash flow. We are obligated under the laws to hire a CPA and everything will be handled and accounted for.
Hi rheoretro,
First of all I commend your and everyone in putting their effort. I totally agree with you that we need more people and money. I think people are first to come and money will automatically follow.
While word-of-mouth is effective we can augment this to get attention using other means:
1. We can persuade news portals to advertise for our cause in a corner that might help us to get more people. Most Indians I know read Indian news everyday. If we can convince e.g., eenadu.net a telugu newspaper, to run ads we can get attention of lot people.
2. Please start selling the current acheivements that are not confidential. Like you might have been successful in persuading a high profile senator about this problem. Put his quotes on our site and also possible grab attention from bloggers.
3. If we can also tap academia who support skilled immigration that would help us. Let us put there studies in our reference section (I am assuming we didn't do this yet). This
makes senator to reference our site and make their lives easy.
4. Please do not discount freewill members who do not have a GC problem but savor
helping others with immigration problem. It could be Americans or Immigrants we'll get them all in.
I think these actions will help us grow our strength. I know it is easy said than done. I will send a mail to rediff and eenadu to put our banner on their frontpage. If anyone has contacts working for these website. That will make it whole lot easier.
-Kishore.

As someone who has talked to the congressmen and their staff, i can say that they do keep track of the number of people calling to support or speak against a bill. They can judge the public support or backlash easily. Talk radios inflamed anti immigrant groups who made thousands of calls. We on the other hand analyze the bills to death (in process provide talking points to the opposition), ask for minute by minute updates and start daydreaming on how we will celebrate when the bills pass. We make one call and expect immediate results.
You might be a 'voteless alien' but realize that you are supporting an economy of 'voters'. In your spare time calculate the amount of money you spend and the ancillary jobs you directly or indirectly support, you will be surprised.
Finally, the IV folks have some experience and they say things based on some background information that you might not be privy to. Also realize that many hardworking members of IV have their green cards and they are still working for the likes of you and I. I can understand that your post could be an immediate negative reaction of the amendments failure but the fact that you care shows that there is point to your pointless wait.

MurthyDotCom : MurthyBulletin (http://www.murthy.com/bulletin.html)
Conclusion
MurthyDotCom
Employers whose business model may be viewed by the USCIS as within the third-party placement are likely to face RFEs in their H1B petitions. Such employers need to review the factors set forth in the memo as indicators of control, and anticipate the need to prove control over their employees or modify their practice to incorporate the factors to establish a direct employer-employee relationship. This memo is significant to the IT consulting industry, and could disrupt many other business sectors. Absent this source of workers, the end clients would be forced to change their business models with regard to how they meet their short- and mid-term IT needs. The impact would not be limited to IT consulting companies, but would also be felt by their clients, which include many of the largest U.S. companies and even the U.S. federal government.
MurthyDotCom
The Murthy Law Firm recently has responded successfully to RFEs on the employer-employee issue. To the extent appropriate, we will utilize the new memo and USCIS update as additional guidance on acceptable evidence in such matters. The memo appears to change prior, established practice and law. It is inconsistent with other federal statutes in defining the terms "employer" and "employee." A challenge by H1B employers may be required, unless the USCIS reconsiders or modifies its position. We at the Murthy Law Firm remain available to assist our clients in connection with H1B cases, including issues that will arise as the result of this memo.

Yes you called sleazy consultants..check your stmnt.
Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..
"Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.". Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.
Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.
VERY valid point. But my question is, do you support it?
A fictional scenario to check whether you are ready to take advantage of a loop hole if its in your favour.( A nice quote on this -Everybody likes discrimination when its in their favour and they dont raise their voice then)
Yes, nice quote and very true too. But again, that is not the argument here.
My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Comparing one wrong doing with another does not justify as an argument. It is actually a logical fallacy. In other words, 2 wrongs do not make a right. Try doing that in the court of law.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..
Malpractices are criminal (if law is violated) but a corporation cannot be tried criminally because it cannot go to jail.:)
You may have noted that I did not bring up morality even though I wanted to because everyone has a different measuring stick for it.
however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.
I totally agree with that. Also, I don't think they will be denied because they did not do anything wrong. System provides them with an option for doing so.
Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast.
That's a perspective and again 2 wrongs cannot make one right.
Check for your reputation here i think it says some thing.
Yes. It is stupidity by consensus.

There are more than just national anecdotes, however. Everyday Americans are affected. Since looking into the H-1B visa program, some of my constituents have come to me and spoken out against abuses they see.
Another constituent sent me a letter saying that he saw firsthand how foreign workers were brought in while Iowans with similar qualifications were let go. He tells me he is a computer professional with over 20 years experience. He was laid off and has yet to find a job. He states: I believe [my employer] has a history of hiring H-1B computer personnel at the expense of qualified American citizens.
I received a letter from a man in Arizona who works for a company that employs dozens of H-1B workers. When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.
I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?
From How Safe Is Your Job? (http://www.parade.com/articles/editions/2007/edition_07-01-2007/Intelligence_Report) By Lyric Wallwork Winik | parade, July 1, 2007
You could lose your job to a foreign workernot because hes cheaper but because he has better workplace skills and discipline. Thats the message Labor Secretary Elaine Chao hears from U.S. executives who are worried about Americas competitive future.
Beyond the cheaper cost of labor, U.S. employers say that many workers abroad simply have a better attitude toward work. American employees must be punctual, dress appropriately and have good personal hygiene, says Chao. They need anger-management and conflict-resolution skills, and they have to be able to accept direction. Too many young people bristle when a supervisor asks them to do something.
As for our job future, Chao notes that most of the fastest-growing jobs today are in industries requiring advanced knowledge and skills and are very high or high wage.

Do you know if they have a record of everytime we talk to the CSRs?
I have only been able to talk to an IO once, and I feel they definitely have more info than these CSRs who are sitting there like bots. To get to the IO, I basically had to tell them that I have not opened a SR so far (which was not true).
When I tried calling yesterday, I told the CSR, that my attorney opened a SR on 1st September and if she could kindly transfer my call to a IO. She said she will not be able to transfer my call, as I had already opened a SR. When I told her that I already got a response for the SR, so I now need to open another SR, she said she cannot as it asked me to wait for 60 days. I requested her a couple times to please transfer me to a IO, she said, Sorry, cannot do it as you have already opened a SR.
I am planning to call them next week again, will tell them I have not opened a SR yet. Atleast, I will then get to talk to a IO.....!!

Pappu,
2. I have told this before but would like to repeat now... I don't contribute because there is nothing for CP filers here. VISA recapturing is the only effort that would benefit CP filers but anyway the chances of that bill passing is close to 0.
In my opinion, the biggest sufferers are people in EB3 India or China and who have opted for CP (now guys, don't start lecturing on CP vs. 485. We have heard it enough).
willwin I understand from your posts that being in CP with retro dates is very tough. No point in trying to compare whose situation is tougher.
We have a few bills that will help everyone. Instead of getting disheartened, follow you handle and participate in IV efforts.
The way I see it, if we take action, chance for success increases no matter how minuscule it might seem.

It is not just wife's work permit problem. If you don't have GC and your kids are entering the college, they are not eligible for any scholarships are student loans. I am not endorsing any fund or product. You have to do your own research and you have to figure out your own risk appetite- Disclaimer
Superfund is a hedge fund which has two funds of managed futures. Its enrty was $5K last time I checked. But again in a hedge fund you typically pay 2 & 20. That means 2% maintenance and 20% off the profits and there is huge down side risk where your entire investment can be wiped out. Tread carefully!!
Again a great post. Just want to comment that be careful with ETF's too. Most of the ETF's are not physical commodity holders. They play in futures and OTC swap markets.
I have looked hard to find ETF's or MF's fwhich are pure commodity holders e.g gold, silver etc.I still have not found good ones. The closest I could get was some portfolio of mix of real assets and futures. Most of the ETFs are again leveraged and kind of trap for average investors.
There are a few hedge funds or big funds which might offer pure plays but those tend to have huge entry investment requirement basically making them inaccessible to individual small investors.

Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous. But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series. We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. We being here is best for our country and our economy.
I am with you. We like to invent all possible reasons to try to show our importance to America, but it is obvious that reverse brain drain is not a real thing.
American will do just fine without all the foreign programmers (including myself) living and working in this country. They can find Americans to do the work or if not, they will offshore jobs. Either way, life will go on as before.
Foeign born programmers are not here because they are exceptionally bright, they are here because they could get a college degree and get trained in programming skills at a cheap throwaway cost, which is harder for an average American to afford. So the foreigner gets to write programs while the American has to settle for a sales position in Best Buy.
What America really needs; what they cannot do without are the maids, landscapers, construction workers and janitors. The politicians who have to make the decision of sending out illegals have to deal with the problem of not finding maids and gardeners for their expensive homes (their wives are not going to let them do that). Easier for them to let the illegal issue prolong while they enjoy the benefits of cheap labor providing by illegals.
The GC system is entirely in our favor. It really does not benefit America in any significant way. The fact remains that we still end up stealing their jobs at some level - whether we are willing to admit it or not.

guys and gals,
Cool down. Remember we are foreigners in this country. We need this country more than they need us ( as they say, graveyards are full of indispensable people!). A country is not considered advanced by the cell phone models people use, but rather than how much food they produce, what is the standard of living, how many noble laureates it produces per year, etc.
Besides, in my 7-8 years living in this country, first as a student and then as H1 worker, never once have I felt being treated differently because I am a foreigner or look different.
Now compare that to living in Europe (you will be treated as dirt as soon as you enter airport), it is racist, living in past and full of bureaucracy.
As for India, mera bharat mahan, but I remember a time when I had to pay bribe on the train ticket counter to get a measly 2nd class sleeper ticket, or just to get a electric connection, would dare not get near a policeman, etc. etc.. The list is long and I suppose I everyone here knows what I am talking about.
So please ask for your rights but remember you are in their country, nobody forced you to come here, and beggars can't be choosers.
Not for very long. There are bigger, faster markets than US in the world.
A joke, right? Financially maybe, technologically never. Most European countries are far more technologically advanced than US. I'm sure Japan, Hong Kong, Singapore also are all more advanced than US.
For example, only US is still using paper checks to transfer money. Using coins to pay for a phone call in phone booth. Still has no control over who lives in the country, or who goes in and out. Still not using computers for processing immigration applications (Why do I have to send in the same papers 10 times, send in tax papers, give my background info, give fingerprint 10 times.... and this all on paper... come on it is 2007 not 1907). Still drive around in cars instead of having a good inter-city connectivity with trains. No high speed trains. Still likes to see rubber stamps on official papers and believes it has any kind of value.
And so on and on and on.... I could write a book why US is behind most civilized countries. But thats ok. US is what it is.
But the worrying part is; it is going to get even worse when they kick out all the H1B etc who are here legally and provide free knowledge. And instead keeping the uneducated mass of Mexicans or south americans who run across the border illegally and then given amnesty by some fool in Congress. Good luck with that project.
Not a country I want to live in or pay tax in.
