Couldn't disagree more with kaisersose or guns. GC system as it exists is rubbish and ugly in many ways- but as bad as it is that's what's legal and in place now so we have to go thru that and if possible, make it better along the way appealing to the saner elements of the society. Brain drain is tricky - you guys are honest enough to admit to not having it so theres clearly no drain there but other programmers will disagree. Some history lesson's also in order - will do it later. But that's why america needs me - i'm an annoying reminder to its core value(related to immigration) when a section forgets it or finds it inconvenient or abhorrent- and if i were to shed some modesty-and i'm going to-, i'd grandly say i'm here to remind some countrymen about what it means to quintessentially be an American

indian outsourcers have not intrerest in GC- why should they? After GC they lose their stranglehold on the employees...all they want is more H1Bs...
And on this issue too (h1B), they may actually end up hurting themselves, given the current climate in the US. Its too bad (and really unfair) that our issues are usually linked with the H1B issue...:(

can the H4 not apply for a new H1B? Is H4 barred from applying for H1B? If not, I don't see where the prob lies. plus how will this solve the retrogression issue?
Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.

anyone who is in the same boat - write on the forums - help each other and provide any nugget that could change the game...I do believe I got tremendous help from this forum and the morale support that was needed just to bear through each day. It helped me with my emotions and provided guidance and some comparisons.

Anti immigration group targets all of the immigration. You can see numbersusa website. There are 2 reasons for the hate towards H1b and L1 program. Fraud and abuse is more in H1b. 20% was found by USCIS. Many fear it could be more. Mainly Indian bodyshopping and consulting companies are main reason. Another reason is many fear that H1b and L1 program is main reason outsourcing. Many big companies laid off US workers and did outsourcing to cut cost and they were asked to give Knowledge transfer to the onsite resources (those who are H1b or L1). Number of jobs in High skilled are very less (may be 2%) compared to low skilled in US. So they think 65k is more in percentage terms. US congress expects that H1b should be used only when no US Workers available. That is the reason there is no support at all at congress to increase H1b Cap. When they put a H1b restriction for TARP companies it was passed uniamously. So if we need EB reform just we need to disassociate or take neutral stand on H1b. They cannot remove H1b as it was with WTO.
I always wonder why give GC to 50k people regardless of their education experience and harass the 65K master degree/highly skilled tech worker ? Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..
"Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.". Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.
Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.

My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Comparing one wrong doing with another does not justify as an argument. It is actually a logical fallacy. In other words, 2 wrongs do not make a right. Try doing that in the court of law.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..
Malpractices are criminal (if law is violated) but a corporation cannot be tried criminally because it cannot go to jail.:)
You may have noted that I did not bring up morality even though I wanted to because everyone has a different measuring stick for it.
however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.

Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast.

Hello I got a yellow form 221(g) during my interview. Got my passport and approval back during the interview.

Here's an anecdote -
This was back in the late 80s, when I was growing up - in Bangalore.
India had just lost the Finals of a well fought [field] hockey match to Pakistan. We were all very disappointed by the loss, but it saddened me further to see a victory procession with waving Pakistani flags in the Muslim parts of the City.
Ofcourse, India is a secular country and more so the United States.. and you can cheer whoever you please..
But, If you chose to become a US Citizen, and US were in a battle with your country of Origin (let's narrow it down to Sports, to keep it less complicated), which country would you side? If I chose to side with my country of origin, it would make me a hypocrite, wouldn't it ?

in year 2007 EB-3 india got 17,000 green cards, still not enough to take care of the high demand. there are just too many people waiting, that's the fact and nobody can do anything about it...except for supporting IV for these three bills...
