Did you use PO box as address on I-485? I had heard USCIS does not accept PO box as address in I-485.
they do according to my lawyer and I got my welcome notice the last time sent to my PO BOX the first time they sent the Welcome notice they sent it to my physical address not PO BOX but because the address didn't have the C/O name of my friend and then my name so the mailman when He read the name and looked in the mailbox he didn't found my name so he returned it to the sender USCIS if USCIS wrote C/O...he would of let it (the mailman) the second time USCIS sent it to my PO BOX directly ( what they did they included the original envelope that was sen to my physical address with the return to sender tag and the time received and sent ... + the original Welcome notice with the physical address on it all these two item sent in another envelope sent to my PO BOX

Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.
As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,

what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..

But instead .. someone says we have a signed petition of 25000 members effected by immigration mess �. And it�s a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!

Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.
That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.
Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!

Domenici today offered the Welcoming Immigrants to a Secure Homeland (WISH) Act of 2006. The comprehensive measure is the second major border/immigration bill offered by Domenici, who believes in a two-step reform approach�secure America�s borders and reform immigration issues. In November, he introduced the Border Security and Modernization Act (S.2049) to address border security issues.
�As a border state Senator and the son of immigrants, I have a unique perspective on immigration. I understand the need to provide a secure homeland for my constituents who see the problems caused by illegal entries into our country every day. I also understand the need to welcome immigrants to our country, so that America remains a country where hard-working, entrepreneurial, and intelligent immigrants can prosper,� Domenici said.
The WISH Act would authorize a series of reforms to U.S. immigration laws including:
� Improving immigration law enforcement
� Creating a new guest worker visa
� Establishing a process for illegal immigrants in the U.S. to gain legal guest worker status
� Improving foreign student, highly-skilled worker and visitor regulations
�The time is right to fix our immigration laws, which are not working properly,� Domenici said. �My bill strikes a sensible and realistic balance between cracking down on illegal immigration while encouraging legal immigration. Slamming the door on immigration or unilaterally deporting millions of illegals already in the country is just unrealistic.�
Domenici said he will encourage the Senate Judiciary Committee to carefully consider his WISH Act and S.2049 as it readies comprehensive border security and immigration legislation for consideration in early March.
Domenici�s bill would increase the number of Department of Homeland Security personnel to investigate human smuggling, employment of illegal immigrants, and immigration fraud. The bill would also increases penalties for violations, as well as provides a system for verifying worker employment eligibility.
The bill would create a guest worker visa for up to three 3-year periods (9 years total) for immigrants to gain legal entry into the Unites States, and potentially apply for permanent resident status. The bill would allow 500,000 such visas the first year, with subsequent visas increased based on market need.
The measure establishes a program to allow illegal immigrants now in the United States�estimated at up to 12 million people�to apply for legal guest worker status. This proposal entails paying a fine and obtaining a legal guest worker visa.
The bill would clarify the limitations and restrictions placed on student visas after 9/11 in order to allow high-tech foreign workers and full-time foreign college students to study, work and travel in the United States. It would also establish a means for foreign students who graduate with honors to be allowed to work in the United States.
The following is a summary of the major provisions of the WISH Act:

? Requires DHS to add new investigators and enforcement agents to curb human smuggling, hiring illegal aliens and immigration fraud, and add more personnel to process student visa applications.

? Creates a program to allow aliens who are illegally in the United States to obtain the above-referenced visa without leaving the United States. The alien would have to pay a fine for being in the United States illegally and go thru the same application process as aliens applying for the visa legally. These aliens would have to apply for this visa within three years of enactment of the WISH Act. If an illegal alien fails to apply for the visa and remains in the United States illegally, he would be removed and not allowed to apply for any immigration benefit except asylum. After being in the United States 5 years under this visa, any alien who had been in the United States for 5 years prior to the date of enactment of the WISH Act would be eligible to apply for a different visa (but not permanent resident status), but such a visa would not be issued until the alien left the country and reentered thru legal channels. If no new visa is acquired for such aliens, and for all undocumented aliens who have been in the United States less that 5 years before enactment of the WISH Act, when the initial visa expires (after up to 9 years, assuming the alien renews the visa and remains employed), the alien would be required to leave the United States for at least 3 years. My already high regard for IV has increased 10 fold with this clear message of yours. It was high time for all the people issuing threats that�s they would leave IV if there ideas were not accepted by IV, to just leave and do everybody a favor.
Bravo, I salute you for your courage. Hope people will come in line and back IV core decisions and don�t fight each issue.
Either lead or be lead. The people in the core team have come forward sacrificing there personal time and money for our cause. So lets just follow there lead and not fight IV core teams decisions.
Before this thread takes a turn where supporters and opponents of this idea start another forum war, let me say this clearly:
IV is not going to adopt this as an agenda item. The reason is quite simple: H4s not being able to work is low on priority of problems that need to be fixed in order to mitigate retrogression or other consequences of retrogression.
And frankly, we do not have extra kind of support to add new agenda items on our list.
A whopping 200 people signed up for recurring contributions of $20 per month. Out of 8000 people who registered here and got emails about it. However, almost every week, there is no shortage of new ideas and no shortage of opinions on those new ideas from people.
We get $20 deposits each month from 200 people. But as far as opinions are concerned, we get hundreds of them each week. How nice? I wish we had some machine to convert those opinions into dollars.

My wife appeared for Visa interview on 6th and yet to receive the passport. we booked tickets for this weekend and seems we have to reschedule. I sent a mail to NIV and no response as of now.This is of concern. can anyone tell me about the normal turnaround time for H4 Visas these days?

I just got hold of one of the consulate staff and she told me that they are having some problem with PIMS database for background check and there is delay in processing passports. The lady I spoke assured me that, latest by Mon/Teusday of next week, we can expect passport. I will try to reach vfs in the evening and see what they say..

This may not be related to this issues but I saw an update of 09/25/2007 on my H1 case with a previous employer whom I left in 2004. This case was approved in 2003.

AC21 doesn't contradict any law. AC21 memo is a real memo. It provides guidance for areas that are not clearly defined. So no point in comparing AC21 memo against the latest illegal memo by USCIS.

When can you file WOM? It's a grey area. When the Name Check has been pending for more than 2 years like in my situation, then you definitely have "a case". However, I have heard that some people do it after "only" one year.
Impossible to tell really when it's the "best" time to do it...
