Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

Since I did not set up the website, I am not sure how members and guests are counted, but I can tell you from my own experience that I log in when I have something to say or when I get prompted. So many times if I just come and quickly see what is new, I do not log in,....that might be lazy but I figure many do this, hence the number you see could be 300 members and 133 guests or so....
I see 136 members and 297 guests online! I wonder why guests have more tensions than members?

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

I would have taken it seriouly if you didnt spend six years in the US and did not run away to the Canada. Atleast if you gone back to india, it makes much more sense.

The reason why change is not happening as much as we want is because we face tough opposition. The only way we can overcome this is by being stronger. We can definitely become stronger if all H1Bs, L1s, EADs etc come together on this platform. If each simply come, read posts, post comments and go away... it is tough to get anything done. Holding a rally is a good idea but we have seen how much work and resources are needed in planning and executing it. It can only be successful if several thousands turn up. Advocacy is a slow, long and painful process and requires lot of patience. Each member must take part in the advocacy effort and support ImmigrationVoice. The first step is to believe in IV. Believing in IV means believing in your abilities and the collective power of this community. There are many sharks out there with selfish interests who try to pull you down so that their own interests are served. Be a part of Immigration voice by supporting its monthly subscription if you cannot give your time to IV on daily basis. Join your state chapters and play a leadership role in organizing events to mobilize and increase membership in your states. IV will provide all the support and guidance you would need for lawmaker meetings. . IV is all of us. We all need to work together and make things happen.
Visa bulletins come and go and if we only keep watching and expecting miracles in bulletins, then we would be wasting our time. writing posts, tracking and blaming others will not solve anything. Each reader of this post should join this movement actively if they desire a change.

The definition of failure is repeated measures over a certain period of time. The only way you can galvanize the Indian community towards IV is by, hosting something big. Otherwise people don't like to get involved in to something which is old news.
IV has become old news now, I and some other members, I am sure feel, something big needs to be done. The problem is IV is lacking a good leadership--- please don't take me wrong, you have been a great help, but moreover in the past. What I am proposing is, a big rally in DC.
I know it is hard to deal with Desi's in general, OUR MENTALITY IS OF A FREE RIDE, but this free ride is heading towards a deep pitch.
And moreover, people just come and offer their view points, I believe this organization should be more than that, involvement in STATE Chapters, and meeting with other state regulators, will not create a loud voice.
I totally disagree with you on that,
if illegals can create a loud voice even after being illegal, then what is stopping us? Organize something, but don't ask to be involved in state chapters, I will not waste my time, running and begging authorities to consider legals, when others are creating a loud vigilance.

you should get it soon. Call the service center where your case is to check further as online status is not a good indicator. In my case per TSC i was approved on 9/4 but my online status did not change until 9/11.

This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.
Yes it is unfair in some ways. Couple of my very close friends (who are also colleagues) --one is of Lebanese Origin, raised in Dubai, and the other, Taiwanese Origin, raised in Uruguay. They are in similar Finance positions as I (though I am a step senior) had the entire process, from the PERM, to card delivery, completed in 11 and 7 months, respectively. Whilst I am waiting the last 5+ years. It can get you down at times, and feels like living in a constant state of "temporariness". However life does go on :)

Ok, if advertising is too far-fetched, then hold some cultural events and make money on those. Brainstorm with members to find other ways to make money.
Organizing cultural events does sound like a good idea, but again the problem is "organizing". I volunteered in a few cultural event organizations and know that its hardwork and need many volunteers even in a small city (especially if its a fund-raising type). My understanding is state chapters are crying for members, if state chapters have enough volunteers it would be a good idea.
I think there were many brainstorming discussions on fund raising earlier on these forums. The problem with these anonymous forums are that anyone can give a suggestion and then do nothing about it (I am guilty of the same sometimes). Thats why I liked the idea of state chapters where members know each other and may be able to motivate each other to volunteer some time/money/etc.

- Actions speak louder than words. If Murtha becomes the majority leader in house than Democrat agenda for 2008 presidential agenda will be Iraq not immigration. That doesn't mean no immigration reform, just not in the "lame-duck" session.

One more thing. Working on EAD can be preferred to both categories, ppl who has consumed all 6 years and ppl who haven't yet.
1. If you have consumed all 6 years, according to above link, can file MTR if 485 is wrongly denied due to AC21. EAD remains valid till atleast the appeal period. while if they are on H1 extension beyond 6 years, H1 is cancelled with immediate effect.
2. PPL who haven't consumed 6 years have an added advantage to come back to H1 and guess what, he can (if needed) start a new GC process while retaining his older PD (as his 140 was once approved, he retains that PD for life).
I found this by extremely intense research on internet, CIS website and many well-known lawyers forums, chats and discussion. However it is always advisable to consult your own attorney.

I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?

Well per=country limit is part of the iNS law. So its legal.
From an immigration perspective, green card is a privelege extended to "aliens" and it is the prerogative of the law to ensure a formula thats best for the country.
INS family based immigration law was the one that conjured up the per-country limit to prevent folks from one country from flooding in. Unfortunately, this formula made its way into EB immigration and we are stuck with the consequences today.
So if anything, we should bring up the fallacies in per-country limit as far as skill-based immigration is concerned and get the law changed.
A lawsuit isnt the answer to everything. The chinese EB folks learnt that after spending thousands of dollars and few years on their lawsuit, the judgement they got back was that 'the law is being followed'.
And the comment below about the constitution forbiding anything, with respect to immigration law, is pure nonsense.
A question -- has IV considered challenging the country quota in court? Because the Constitution forbids discrimination based on country of origin..

As your lawyer used the words "change of employer petition", it seems that one can use AP to travel and still after coming back he/she can file for either extension, amendment or transfer. This answers the main concern that I started this thread for.
Also, on other threads I read that its possible to file H1 amendement even if your H1 is still valid. This is one way to come back to H1 status and get a New I-94 card.
Some one also mentioned that if you have a valid I-797 extenstion approval notice and if you show that at POE to IO, he/she may issue an I-94 till expiry of I-797 (3 years) instead of AP (1 year).
I would appreciate input from others who have some knowledge or experience of above situations.

Why not, we need all of you to be active state chapter members. If you are then this is not for you, but if you haven't already, then join and make a difference. We can have interesting discussions and there is absolutely no problem with it, but we also want members to further IV goals. As the model followed is an all volunteer model, all of us know, volunteering does not come as given for everyone. Some need to be inspired, so need to be pushed, if we did not have people who did this, IV would not be existent. Try to understand why people ask everyone to join state chapters. I will stop lecturing now, but yes, threads need to be hijacked to get the point across. Without grass roots organization we will not make any progress and will defeat the whole purpose of having an organization being build from the ground up.

A member-driven and membership-driven organization will not have to taunt members into contributing or shaming them to contributing, imho.
If we become verified and paying members, personal email messages can be sent out for the (less frrequent, perhaps) funding drives. A code of etiquette or something akin to it should be enforced that spells out the rules of participation in forums as well, and discourage such comments.
You pay the basic membership - you get on board. When extra funding is required, you do what you can - there's no extra pressure or shaming anyone into contributing.
There can be *plenty of other benefits*, and an organization sufficiently large enough can probably generate enough revenue to have at least 1 full time person on board coordinating stuff... or a bunch of volunteers and part-timers (for folks who have their EADs and are using it, this would be a chance to jump in... and help out).

I like the idea of an annual $100 fee to join.. that way all members have contributed.
Secondly, i think while a forum method is good, the Administrators should stop posting vitriolic messages ( For Ex: " I cannot believe people are not donating" / " you should be ashamed.." and such).. This creates a very childish image for this organization.
If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.
My thoughts..
If we become verified and paying members, personal email messages can be sent out for the (less frrequent, perhaps) funding drives. A code of etiquette or something akin to it should be enforced that spells out the rules of participation in forums as well, and discourage such comments.
You pay the basic membership - you get on board. When extra funding is required, you do what you can - there's no extra pressure or shaming anyone into contributing.
