Having seen numerous threads in which the exchanges became rude/sarcastic/rude or even outright abusive and vulgar, I was hoping that this would not become one.
Ron, while you may have a point in what you say, sarcasm and taunts will get you no where. As you said, the 'antis' are gearing up, suggesting (I presume) that the effort of all of us should be more concerted and determined. But you are not doing yourself any favor by saying the things that you do.
Raji had a point of view, and has not been rude or offensive in expressing it. In fact, her/his first post was out why it is not good to use the AILA template. Well, PASKAL did try to address. Raji's tone or tenor of posts did not merit a peremptory reply, much less a rude one.
Be that as it may, I do believe fervently that even if someone insists/demands an answer, you can always ignore it instead of being rude or aggressive.
That way there will be more people on IV'S side.

If you do not intend to use EAD/AP, there is no need to even apply for or renew it. You can apply it anytime when AOS is pending. What is the new annual fee for EAD and AP?

People who want to put FD(fixed deposit), try FDs related to NRE accounts. It gives higher return+ you can get the money back to $$.

Whatever you do, don't flee the country. You might never be able to reenter again. And I don't know what kind of extradition treaty the US has with India so I don't know if fleeing will even help. I would say defend yourself and cross other bridges as they arrive.

Ok, lets not confuse this case with Ability to pay and get worried about that stuff. I spoke to another person who contacted me and is having the same issue. His 140 was revoked 2 years back and at that time he got a NOID and responded in a timely manner and he was fine. Now he has a denial on 485 stating that his 140 was revoked 2 years back.
This person is neither desi nor did he worked for desi consulting company or had ability to pay issues and has applied for MTR and waiting.
All that float on internet is "indivisdual prespectives" and "interpretations". So do not think too much about it.
AC21 guidelines are clear - you can refer to them on DHS website, Ombudsman's page, USCIS website etc....
From what I have been seeing and as I did a lot of research and continue to do, 140 revocation and 485 denial does have a pattern and this seems to be a procedural or a serious training issue.
Thats why IV core suggests that we have to collectively gettogether and fix this issue and any other issue.

Filed to TSC in January 2008 and I just got the RFE from TSC for my EB1-OR
petition:
It says:
"On the I-140 submitted, you failed to complete th form as requested. On
Part 5. Additional information about the petitioner. You did not complete #2
. in reference to the Gross Annual Income or Net Annual Income. For
companies of 100 or less employees, the petitioner must submit the last two
recent quarterly reports which lists employees; wages and social security
numbers as evidence to ability to pay proffered wages.

I worked in a small start-up company with 20+ employees. The company has

140 form part 5, #2 I put "0.00" for both Gross Annual Income and net Annual
Income according to the information I got from my employer.
The lawyer I hired filed my I-140 (I got signature from my employer) WITHOUT
my W-2 form or my last year pay-stubs. In stead, he attached my W-2 form
and three month pay-stubs with my I-485 application.
Now my employer refuses to give me those financial statements listed in the
RFE letter, what should I do?????

Apple: If you dont have assets, you dont have much to lose anyway. The insurance company lawyer will protect the company in the end and not you. It makes sense to have your own attorney to indicate to other party's attorney that you dont have much money to pay them. I think what other attorney told you makes sense. When the plaintiff sues, he needs to include everyone or risk elimination of the case.
I feel sympathy for the stress for you and family and dont know the situation of the family suing you. But since lawyers are involved anyway, respond to other party through a lawyer.

- Talk to the leaders of this campaign. Do not just sit back after voting. Ask what help they need and what work you can do as a volunteer. People affected need to take lead and work hard for any fix. This will not cost you any money. All you need to give is your time.
- Consider signing up for recurring contributions every month. It takes lot of resources to run an advocacy effort and your support is critical.

I posted this before, but got nowhere (read: did not get the answer I hoped for), hopefully people with little bit more legalese can answer on this discrepancy.
According to 8usc 1153 (b)(3)A : "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2)".
Which means that EB3 should be getting the unused visa numbers from EB1 at around the same time as EB2, and not only if EB2 also does not need the numbers.
Is the reading that EB2 and EB3 should concurrently share the number on the right track? And if so, is USCIS rolling over the numbers in the right manner?
If EB3 were to get rolled over numbers only after EB2 is satisfied consuming EB1, the language would have been similarly worded as the last part of 1153(b)(3)A "... to the following classes of aliens who are not described in paragraph (2)".
