In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.

Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.
The effective date could be one of the amendments .... it is changeable.

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..
I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"

Have decided to dump my H1 for good and start EAD on my new AC21 job soon.
getting job on EAD is much easier than h1b sponrsorship. AC-21 law was created to protect employee because of processing time taken by INS at that time.
At that time, USCIS ( former INS ) was taking probably more than 1 year.
By law, you can safely jump on 181 days and a lot of people are thinking of that for whatever reason. But my take will be that you should not jump on new job if
- If you are relatively stable in ur job and compensated ok.
- ur PD is very old (2001-02) because you case may be close to adjustication.
- You may have greater challange keeping ur new job if economy went south
if you get laid off from a job then it is much better to get a job on EAD rather than H1b. Probably underlying intention was AC-21 to protect alien in case he gets laid off. I know a lot of people take taken advantage of AC-21 and it is good.
BUT final regulation has not been published and USCIS final rule of AC-21 may be severely restircted in final rule (especially with July VB fiasco)

looking at the sarcastic, venomous and abusive responses, make me wonder why some people are so insecure and touchy. Why is there a my way or the highway mentality. Or may be some are happy living in illusion and don't wanna be shown some reality. couple of points
1) again none of us will be treated same as American. Some of you mention BO as role model, remember his mom was American and he was born in Hawaii. had he been born in Merrut, you wont have been talking bout him.
2) I got canadian PR not because i want to move there or anything. I got it cause its a good backup. If things dont go right in India, i can always come back for few more years. But this time it will be Canada. And before you guys start crying again, Canada has no problem with someone keeping a PR as long as he spends 2 out of 5 years in Canada.
Again, just the sheer number of people from India, China and Mexico running after PR ensures there is a long waiting line. No way around it. So either wait for your turn, or explore other alternative. If you want to spend time howling, crying and protesting, well good luck with that too. It only makes American look down on us as GC seeking lowly, noisy, needy immigrants.
Look up how immigration is done in NZ, AUS and Canada, that's a dignified way and then there is this USCIS way which humiliates you at every step. So the choice is there, its just tht we r too stuck with american GC

This is what I mean by fingerpointing. So why are u so special? Just because u claim to be honest u must not point fingers at others. You know, there are often times we all get upset that some stupid questions make it to the list, republican debate was one such yesterday, today's democratic one looked better. I hated that they did not ask our question inspite of it being the 2nd popular one but I personally think the question was too damn narrow for them to care.
For us, it may seem the world but for them it is just a technicality/one of the several points of CIR. Both Clinton and Obama seem to always chime in and act all gung-ho about legal immigration coming first.
Whenever they are asked about any frig'n immigration question, they throw the buzz word 'comprehensive immigration reform' and that folks, covers the entire gamut. The worst part is, on this issue the entire front runners look the same, well, almost. Mitt R is against but John, Hillary and Barack all seem to sing the same koom-ba-yaa song about CIR.

Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!.
