Did Anybody Successfully DID a H1B Transfer After Entering US on Advance Parole??
I wanted to know the answer for above Question.
I understand that we can do a H1B extension with the same Employer after
using AP.

You have to be aggressive and presistent to get a new job where you get better pay that is above the prevailing wage.
Secondly, if you are being paid lower than prevailing wage right now in H1B, your company is breaking the law and you could be in trouble too.
You need to get out before this thing turns into a nightmare and put your resumes out there on monster, dice etc...and GET THE HELL OUT. The job market is good right now and this is the best time to look for jobs that you can
1. Stay there for 5-6 years while you GC is processed.
2. Has decent pay, well above the prevailing wages.
Do IT NOW before the housing led recession slows the economy down again and job switch becomes difficult. What are you waiting for?

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

Nobody is complaining because everybody has the attitude, "Let somebody else do it, I will reap the benefits". It it the like, "Why should I pay IV when everybody else is paying it; I should just get free advice".
I & my colleague filed a complaint against our ex-employer early this year and the DOL W&H said they will work on our case in then next 3 months; they are currently working on cases filed in the last quarter of 2007. The reason why I filed a complaint was not because I need the money he owes me but because he exploits every employee and I wanted to bring him out in the open (will post the outcome once DOL does something about it). The fact is, as long as the employer knows he can get away with shit they will continue to break rules. Now that ICE is cracking down on er's hiring illegal immigrants you will see that er's will stop hiring them. I think the reason why we cannot get our much deserved provisions passed in the house and congress is because of the fact that today lots of US Citizens and Green Card holders are loosing their job to the people who are illegally present in the U.S. I don't beleive in shit, "Employer's cannot find U.S. workers". The fact is that employer's are not willing to pay workers the wages they deserve. Imagine one hour of Federal wage today after taxes will only get you 1 gallon of gas.
The employers are happier to hire illegals as they can pay them shit wages, they don't have to pay er's contribution of social security wages, no er's contribution of state taxes, no Medicare tax, no workers compensation. Just imagine wont we be annoyed if we can't find a job in India because Nepali or Bangladeshi (no disrespect to these countries) illegal migrants are talking our jobs away from us by working for lower wages.
Sorry for all this rant; I am tired of waiting for GC for the last eight years and am tired of people sitting on their dump xxx hoping somebody will fight for their cause and they will get to reap the benefit. Do you think it might be a good idea to ask people to pledge amount that they don't know how much is going to be ?
I think instead we need to do the following.
1. Clearly state in the very first message the need for creating this thread (pls include the business week article, Pappu's comments, comment from Aman's co worker - If you need help finding it, i can do it for you).
2. Also add to it that this is for the reimbursement of the expenses of the past. We don't really want to concentrate on how this is going to be handled in the future , may be someone can come up with suggestions on what should be set aside as administrative funds and things related to that. This is only for settling the amount already spent.
3. Only pledge is required stating the amount clearly and no funding is required at this time. We will instruct all the members who pledged once we get an expert advice on how to channel these funds.
If you can make these corrections it will be great.

Zoom, thanks for the initiative. Just wanted to make sure if there are any legality issues behind core accessing the IV funds for administrative costs. Because once we donate it to IV funds(unless there is a provision for them to access that money as reimbursement administrative cost) it may not serve the intended purpose.
WE ARE WAITING FOR THE RESPONSE FROM CORE TEAM ABOUT THIS IMPORTANT ISSUE.

Awesome idea, the problem is , i hope i am wrong; the IV "browsing community" is so fractured and pesimistic. any mention of "paid" membership will turn them off .... maybe thats what we need ... Only serious members who really want to make a difference ....

how about breaking this into multiple levels.
(1) account maintenance fee: charge $1/month for maintaining the account, members who paid this fee will have read access to all threads except IV core updates. IV can generate $25K a month with this option, this can cover day to day expenses.
(2) usage fee: charge $??/month for using the IV forums, members who paid this free can post and respond and read IV updates.

I am in same boat as you.
2 i-140's approved with same company, both are EB2, one is RIR one is PERM.
PERM one had Jan 2006 PD where my RIR had Nov 2004.
I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....
