I really appreciate Pappu and this is why I like IV a lot... Staying focused.. I wish I could come to the rally but due to lot of personal reasons I will not be able to attend. ..... and coming back to the focus point of this thread....

...after hearing lots of crap for 6 years, finally I also got my approval on 8/21...no, no, no...it's not over for me...they wouldn't let that happen so easily... they approved mine...but they didn't approve my wife's....so, I am still waiting....just half way through....

8/19 - Sunday 5:56pm - actually this is the MOST important event. So, I shall never forget the time. I received a call in my home phone from extn. 1202. The gentleman with a 50sh voice, identified himself as an officer from USCIS. He mentioned that he is aware my case is stuck and wanted to know all details that I have been complaining about. After hearing everything from me and my wife, he looked into some stuff in his system. He particularly looked in details to whom my cases was assigned to....finally he apologised and told me, probably my case was assigned to AN OFFICER WHO IS NO MORE WITH USCIS FOR SOMETIME...phone call for around 48 minutes...
he apologized again and told me that he would inform Texas Center that there are cases assigned to this person who is not with USCIS anymore...
8/21 - 8:01 am - I got only one mail from CRIS "Approval Notice Sent for I485"
...don't know when I would get the "Card Production Ordered" and "Welcome" mails
Well guys, did you notice the flurry of approval today?...mostly old cases....does that have anything with my Sunday's phone call?.....I am guessing so...
My wife's cases didn't get approved since it is with another officer...hope to get that one soon...
All the best to everyone in this forum....I hope lot's of more approvals to come in September....

I am using a labor substitution (dated 2005) that requires BS + 3 years. I had only 2 years experience by 2005. But I have an MS degree in related field. Would this be ok? Would MS+2 years suffice for a labor for BS + 3 years?
Please respond soon. I have prepared all my paperwork for I-140 and I-485 and meeting the lawyer tomorrow. I am planning to file by Monday. My stupid attorney told me only today that the experience mismatch can be a problem.

1) End date in client letter
2) EE relationship
3) show project validity till h extension requested( 3 years)
RFE response to be received on or before July 10 2010
With all problems from vendor and client i was able to get letters but my lawyer sent the packet on July 9 and when I was tracking the status it says that UPS due to some unforeseen reason will now deliver this packet on 7/12 ..2 days after deadline, the packet has sent date 7/9 and was marked next day AIR
My question is
) Am I screwed in this case and my H1 is gone. current H1 period expires 07/15

It might be possible. Otherwise you can go for appeal if the approval goes south.

I called the general customer service number - National Customer Service Center (NCSC) at 1-800-375-5283.
As I mentioned earlier, I did not go through with the options of sending the info. to the US consulate. But I will give it a try tomorrow. I don't know what you can do with that option (PIMS etc), but it is worthwhile to explore.
At what number did you call? Was it Kentucky Consular Center? Do you mean that we can have our information sent to PIMS system or consulate in India? In other words, does that say anything particularly about PIMS?

Thank you for contacting me regarding the immigration debate in the
U.S. Senate. It was good to hear from you.
As you know, in the 109th Congress, the Senate considered changes to
immigration law. These efforts would affect more than just undocumented
workers here in the United States � it would affect every American in
one way or another.
I supported the bipartisan Comprehensive Immigration Reform Act of
2006, S. 2611, when it was considered in the Senate during the 109th
Congress. This bill would have provided many new provisions for border
security and enforcement and to address legal and illegal immigration. The
legislation would have provided funding to reinforce hundreds of miles
of existing border fences and establish a �virtual fence� comprised
of cameras, sensors, automated aerial surveillance tools, and other
security measures. The bill would also have authorized funding for
additional Customs and Border Patrol agents to assist with security efforts,
and required employers to have a system to verify the required
documentation from potential workers. S. 2611 would have increased the number
of visas for high-skilled workers, including those who have earned an
advanced degree. Finally, the bill would not have allowed for amnesty,
but it would have provided a meaningful way to address the legal status
of undocumented workers who currently live in our country.
Under the Senate proposal, undocumented workers could have earned legal
status after completing all the requirements to begin to adjust their
legal status. These requirements include filing an application, payment
of all fines, fees, and back federal income taxes, and providing proof
of being physically present in the United States and being employed for
five years prior to the bill�s enactment. Undocumented workers must
then continue to show proof of employment and being present for at
least six years after the bill would have gone into effect. Individuals
must also demonstrate basic citizenship skills, pass security and law
enforcement requirements, and complete Selective Service registration
requirements.
As you may know, the comprehensive immigration bill passed the Senate
on a bipartisan vote with the support of the White House. The House of
Representatives passed another version of immigration reform that
emphasized enforcement only. Instead of meeting in conference to negotiate
differences in the respective bills, the House held a series of public
hearings around the country, and refused to meet with Senate
negotiators, and the 109th Congress ended without this issue being addressed.
I believe that we need a comprehensive approach to immigration reform.
Enforcement is important, and securing our borders is important. But
if we focus only on enforcement and border security, then we will only
have addressed part of the problem. Many of the current proposals are
unworkable and would ultimately cause more harm to our economy and our
country. Our immigration policy should also provide positive change for
the future of our country. We should make sure our actions reflect our
security, our economy, and the opportunity that America has offered for
generations of immigrants.

I140 porting is based on an approved I140 from a previous labor and hence is different from labor substitution. Therefore theoretically that labor was not allowed to expire even after the rule comes in to effect. Having said that I would rather pose this question to a lawyer.

Do you think that after announcing that all applications will be rejected, USICS will just keep those applications indefinitely? Come on, we are dealing with a federal government agency here, not some mafia.
I have just thought of something (don't know that anyone discussed this in our forum), what if USCIS do not reject the cases filed for July and keep the packages back for few months or years, just saying...
a) Need to record each application that they have received
b) Need to make sure that there are no concurrent I-140 filings
c) Need to differentiate the packages received in June and July
d) Etc
e) Etc
What will happen to AILA' Plaintiffs? Can they sue just having FedEx/UPS tracking number and the updated visa bulletin?
What will happen to the folks applied on 1st July? They are not going to have AP and EAD in the future. Few of their visas may need renewal soon. How can the travel outside USA? I know there are lots more problems than this.....
What will happen, if Oct Visa Bulletin is moved to up to 2005 for all the EB categories and the people who have filed in July not received the packages back in the meantime?
Moreover, who knows, USCIS may not send the packages back for several weeks to avoid lawsuit. What will happen to the people who applied on 07/02?

We should call the new organizations. But in this case people will talk about this issue for a day, maybe two. The one thing that will catch people's attention is we do something OUT of the way!
I support one suggestion put forward by one of our members - Go the Munnabhai way! Send them flowers! Do you guy have any idea what kind of news that will be? If USCIS suddenly receive 1000s of flowers everyday? Granted we will be spending money from our pockets but that is a small price to pay to make our woes known to others!
This is really a cruel joke played by DOS and USCIS! We should not stand by and do nothing!
So, if people are interested... let us start a send a flower a day campaign!

My fiancee and I got married in India in May 2010 and have a marriage certificate. I came back in June 2010 to US and she stayed back in India. On August 8th 2010 my I-485 got approved. However we have not yet registered our marriage in US (however it is registered in India). Will this be a problem? Did we need to register our marriage in US prior to August 02 2010 for us to be able to file for her green card using derived status? Or is marriage registered in India fine.

What GLUS said is right but the problem is that it was lost 15 years back . There might not be computerized records from that time or if by luck there are they must be archived that there would be no way to retreive them.
Try harder to get any kind of records that you or your lawyer or anyone else in your family might have as additional proof.
And file for the documents as mentioned above . God knows you might get lucky !

I do NOT understand about AILA's lawsuit if the packages don't come back.
But as long as you can reproduce the Originals you should be able to file
485 again if your PD becomes CURRENT - Why Not ??

someone please explain me how complete agreement works. I am working for the client through the main vendor who has a noncompete agreement with my employer (This is signed by my employer, not me). Now I am planning to leave my employer but the client is interested keeping me in the project through another vendor. Can someone explain me if it is possible?
