Hi there,
I received the exact same Email notice from USCIS as you on Sept. 28, 2007. I'm confused! I got my H1B 7th year extention approved in Feb. 2006. What happened to this case?

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.

May be its just me... but i think people like lou dobbs/Chris Simcox of Minute man defense corps/william gheen of Alipac (i think that's his name) thrive on misguiding and benefiting from innocent folks - I don't blame people who are misguided (who for the most part I would like to believe are genuinely concerned about illegal immigration). Its like the radio commercials... you want listeners to remember a phone #, keep repeating it... and the number sticks in your mind.

EB3 I is bad and will get worse. EB 3 ROW will also get screwed big time because of the 300k namecheck victims who are now eligible for visas. Trickle down will also be impacted because of that. USCIS uses short sighted methods to clear their hurdles, they dont realize that there is person behind each visa number. The only thing certain for EB 3 is that in OCT EB 3 will revert back to the June 08 dates.
The sad fact is that most of us were screwed because the lawyers suggested to our companies that EB3 is easier to process than EB2.

I hope any of the accounting Guru's here help me answer this.
I got an RFE for ability to pay. My current wage is 4000$ less than the prooffered wage. My company filed 1120S and there is no net income line on it, there is only a Ordinary Business Income (total income- Total deductions) line which has 6503$. Is Ordinary business income considered same as Net Income?
My Lawyer is trying to include a cover letter arguing that Current wage + Net Income > Prooffered wage. Do you think "Ordinary Business Income" can be considered as "Net Income".

I talked about this IV to lots of my immigrant friends who are in different stages of GC processing. I feel those folks are thinking of getting a free ride with others contributions and hard work. I can only pity them for not being a part of the team. This kind of character would get them GC but would not get them to top in any profession. Still I did not lose my heart. I will keep on talking about IV with them and I beleive, one day they will feel to contribute.

I have written my views to the radio station eventhough I don't listen to that channel as I live somewhere far. I hate to side track the issue but I couldn't control my self to accept that Alexander was great( that apprears in your posts) I stongly belive that he was not great but was a coward (I came to conclusion after reviewing the history)

After some success in the Senate last year, many of us had become very hopeful and we had high expectations. But things have not gone so well in the past few months.
I think it time to lower the our expectations. We should hope for the best and prepare for the worst. If we keep on working some day success will be ours. Long live IV.

I am married too, but i only said that there are other easier paths aswell.
Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.
I don't know, if we are deviating from our main discussion agenda started by LogicLife.

Also, we get paid for getting the job done not working hard. So just a claim of being the most hardworking "class" of prospective immigrants will not cut it.
