Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ?
Were you paid the prevailing wages mentioned in the LCA of previous H1B ? Can this be supported by the W2 of last financial year [Not the paycheck].
Did you have I-94 attached in the previously approved H1B ?
Please answer these questions it might be helpful in finding what might have raised the red flag.

Let's pick up where we left off before this July 2 visa bulletin debacle (and the resulting struggle). Though the whole fiasco did get us our first taste of success, imho, and as such isn't insignificant by any measure.

Folks don't get me wrong, i understand what you guys are going through. my family and close friends are in same limbo. and if any of you has spouse on H4 you will surely know the wonderful status it is to be in. All i am saying is, if there is too much demand for something, there will be a price attached to it. A British can get US gc faster then a Indian cause there are not that many british who wanna come here. and Since USCIS knows we are almost on our knees, they treat us like dirt. Once the demand goes down and more and more Indians will start to look else where, they will start treating us with respect too. Case in pint china, track its history with USCIS, Chinese no longer flock to US, in fact its US who now depends on Chinese money and all and treats its citizens with respect.

I hope they do something about this name check mess soon. I filed 485 in July 2003 and have been current for years now... Just stuck in the whole name check mess.
I even completed the interview for my employment based 485 more than 19 months ago. I do not know what else they want ?

A simple Google search on Immigration Voice has in its fourth hit that Washington Post Article...I don't maintain the page that you were looking in.
Please stop complaining, and stop yelling. Please do something constructive - write that op-ed piece and publish it in The NY Times.

An MS can be completed in as little as 9 months (YES, 9 months, if you apply for MS in a school that follows quarter system and complete coursework but no thesis) for majors like Electrical and Computer Engineering. So what is the plight for folks who completed MS in say 9 months to 2 yrs, and how is it different from the plight of EB3 folks?

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.
If you read (and understand ofcourse), my gripe is not about my lack of ability or desire to file as an EB1, what i was pointing to was the general ridiculous notions being spread that
a) oh all EB2 India applicants are so "lucky" to have filed it in 2006 and getting approval now, so soon
b) EB3 India has been treated "unfairly" by USCIS
c) All of us "deserve" GC asap regardless of the numerical limitations on EB categories, oh this evil system.
Obsessive compulsive LUD checkers calling USCIS at the drop of a hat are a big part of the problem. If people could understand this simple fact that every minute that an IO spends telling some idiot if his name check is cleared or not could have been well spent in approving a GC for someone else. Every frivolous service request hurts the legitimate ones.
These forums were started with the best of intentions at heart and they do have useful information BUT now almost everyday, it is the same old story.....same question, same answer (ofcourse followed by the standard ..i am not a lawyer or go hire a lawyer and topped with oh, i contributed xx dollars to the "cause")
India has produced some of the finest minds in every era. Yet, these forums are more about green dots and red dots; he got approved...why didnt I?; and if someone dares to question, here come the personal attacks....

Many of us are waiting to file I485. Think about them who have filed and are stuck in namecheck for 2 years plus or waiting for visa numbers to get current- they are renewing their EAD every few months (and guess what, they are paying extra money).
Now that the atmosphere looks good for businesses (via increased H1Bs), people who either voted red or did not vote at all, are getting scared of possible democratic party actions.

I have been a member of IV for a long time. I think my only contribution is when I contributed a few times for some of the efforts. I come to this forum maybe once in a quarter just hoping to see some good news on the immigration side. I see nothing, feel bad about it and leave without doing anything. Every time I leave thinking that I should start contributing instead of being a useless lurker, but somehow that thought is the end.
My mistake and I apologize to the regular contributors here.
Anyways I am going to contribute now. I have set up a reminder in my calender for every other day to visit IV and discuss with other members about the next approach to take. I am also looking to contribute whether it be writing letters or taking part in rallies or speaking to lawyers about the spillover.
Again I apologize and I am looking forward to our next step towards ending our immigration woes.
