[Mr. Brown] True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.

A lawsuit should bring things back on track. This is what happened in Jul 07. If it was not for the lawsuit dates would not have become current for Jul 07 filers. I feel there is pretty strong case here considering there are so many people who faced the same thing.

During the last recession & once in a while I see lot of smart guys (lot smarter and lot more educated than myself) move back to their home country. Not because they don't have a job but due to better prospects back home (booming economy et al). They came here since America showed promise.. they left because the way they were treated was not what they expected. Bottomline America failed to holdback those brainy folks. They may have said yes to you. They probably wouldn't have bothered. So coming back to our conclusion. Wrong question.. wrong addressee..:p

When you join a state chapter or a group in your area, it is not necessary to conduct face-to-face meetings everyday/every week, although in person meetings wouldn't hurt. The idea is to create a channel to dissipate information through channels other than WWW. Believe it or not, there are lot many folks from anti-groups who lurk around just to keep an eye on us. Participating or becoming part of the group near to you and encourage others to do the same will also help to build/strength a group of like minded folks in the area who could then team-up to meet with local lawmakers from your area/state. We are a grass roots organization and we need to have a stronger grassroots in order to continue to be more effective. As I said earlier, this channel also is very useful to dissipate information which cannot be shared on world wide web.
Now a days when everybody has presidential election on their mind, immigration issue is not on the list of things to do for most lawmakers. As such, it takes time for the updates and the there are updates that cannot be disclosed on www. We continue to work on our issues in manner we have always worked in the past. And in the absence of Congress not taking up our immigration issues, it some how becomes our fault even though it is ok if some folks would show up from time to time and suggest that they have reasons not to join a google or a yahoo group. And all of a sudden the problem is with organization and the manner in which we work and then there is an urgent to create a �process�. Although you seem to be suggesting that you want all the ducks in the row and world peace issues sorted out before you will start accepting updates in exactly the manner in which you like to receive them. Is that correct? How about the idea of getting actively involved in your area and create an active chapter, which was your idea to begin with, and one I would agree is an excellent idea.
It is of'course a valid question - �what is going on�. Also it is a very general statement and one which can have a very long answer and one which can be answered in few words. If you become part of a group in your area, you will know what is going on. Please understand that a significant number of members are putting lot of effort, if others are not able to participate actively, is it not fair to ask others to help in organizing in groups in the local area and be regular communication so that action items could be handled effectively?

Inspite of having over 25000 members, the admin fix compaign only seem to have received about 10% letters. So, What are the other members doing? Why are they not participating? what is holding them back? That is a question for everyone of us. That is something, I thought every member should reflect upon. We have around 25000 members here in IV. But, we know for a fact that there are atleast a million people waiting in line. How do we reach them and how to get them to actively participate in IV action items?

I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

If you heard what the restrictionist lawmakers have said about what to do with illegal�s, this retrogression makes sense. The restrictionists want to make life miserable for illegal�s by making it difficult for them to get jobs, this way the illegal�s would go back on there own.
They are trying to do the same thing with us legal�s (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.

He seems to twist or omit facts to suit his line of thought and at times states his opinion as absolute facts (most of which can be easily dis-proven by a 10 minute search on USCIS or dept of home land security websites). My friends and I are considering boycotting CNN if this sort of offensive programming goes on unchecked.

I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.
The job must qualify for EB2 first, with at least min prevailing wage!
Which means BS+5 yrs of Progressive Exp or MS as min requirement.

How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.

It will hurt our cause if we continue to announce advocacy effort details on the forum.
Periodically communicating with members stuck in green card backlog in your community/state takes just couple of minutes in a week and is not demanding at all. This channel takes extremely less time to update yourself with what is going on. So that is the channel we are following at this time to share information. As such we request you to please join the group/team in your local area and use that channel to get the updates. When there is an update that can be shared on the forum, we do post the update for all the members.
I received my green card in June-07 and shared this information on the forum earlier. There is one other member who received green card in past few months but for the purpose of privacy it is better for the member to have the choice if/when to announce on forum. I hope you understand and appreciate if someone decides not to announce a specific personal information on the public forum. I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?
2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?
3- When my wife called USCIS, IO told that they cannot do anything before 60 days after the interview. is that true?
I was out of status when I got married so I cannot leave without GC. we want to move to my country but now we are stuck. it is frustrating.
Please someone help...

2. Unforunately it's the same process. I know folks stuck for 3-4 years waiting for NC in marriage-based cases. But do not be scared, it looks like most of the delays are attributed to older cases. It seems NC procedures has been improved lately.

It was a good decision not to leave the country. How many days were you out of status?
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?
2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?
3- When my wife called USCIS, IO told that they cannot do anything before 60 days after the interview. is that true?
I was out of status when I got married so I cannot leave without GC. we want to move to my country but now we are stuck. it is frustrating.
Please someone help...

2. Unforunately it's the same process. I know folks stuck for 3-4 years waiting for NC in marriage-based cases. But do not be scared, it looks like most of the delays are attributed to older cases. It seems NC procedures has been improved lately.

Is Arnold Schwarzenegger pro-immigrants? Maybe he can be approached and have him be our spokesperson... Just him, not the party he represents or the post he holds...

Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.
About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.
