Yes, I just did that last month. I went to take my FP a week before my actual appointment date. I just walked in on Saturday morning. They were nice and helpful. But I did take my 485 Notice and FP Notice, you do need that. Mine was done in St. Paul, Minnesota service center.

Folks,
I got a RFE asking for a copy of birth certificate and bio info. I had sent my BC and bio info before while applying for 485 last august. I was hurrying up my lawyer to send the response as soon as possible.
My lawyer emailed me that since there is a spelling difference in the way my name is shown in my BC and in all other docs, I will be subject to additional security checks and there is no point in hurrying. Is this true or is my lawyer using this as a delay tactic ?
My name in my BC ends with .......iam and in all other docs ends with .....iyan. Should this cause a problem ?
Please share your thoughts and help me.
Lawyers can usually justfy some minor spelling mistakes and answer to RFE. Usually USCIS accepts BC name.
Based on inputs from my lawyer, there is some delay if such descrepency is there - he said that he can reply to such RFE and apart from delay there is no other issue.

Restarting wouldn't be a bad idea in my case as i'm EB3 ROW and i do have an approved I140 on EB3.
But in my case i have over 4 years of work experience, but do not have a masters degree, so any idea if that is possible ?
My gut feeling is that regardless if i'm not able to qualify for EB2, my PD JUN 2006 will get current in a couple of months - just hopefull :rolleyes:

I am not a lawyer, so make sure do discuss with a good lawyer. I am just sharing the info that I know.
US labor laws are good that no organization can stop an employee from joining any organization/company. Even if your company made you to sign a agreement, that doesn't hold in front of the law. This law could vary little from state to state, but not to great extent.
If you are receiving calls and emails from your employer, I would suggest, change the phone number, apartment/house, etc. and ignore him. But you should know that at 140 stage you need experience letter from employer. Make sure you can get it from your colleagues. Or you must cut a deal with your ex-employer now.

My husband's employer filed for green card under EB-1 (OR). I-140 got approved, I-485 is pending. I already did my fingerprinting. My husband's is scheduled for next week. We did not get EAD or AP yet.
Meanwhile I need to travel to Europe on business. I have a valid H-1 to re-enter US. Would my AP get approved before I return to US? If so, can I still enter with my valid H-1? My husband is planning to delay his biometrics until I get back. Are there any problems with this plan? Please advise
As long as you travel on H-!, you have no problems. You do not need AP to travel as long as your H-1 is valid. If you need a visa to re-enter, your visa needs to be valid too, or you can get a new visa based on your H-1.
If you want to avoid getting your visa renewed, then you need an AP.

First to come from India, he probably needs to apply for a Masters in Public Health or some degree like that to come to the US. Then, he has to take the National Board of Dental Examinations (NBDE Part I and/or Part II depending on school requirement) and ace them. Also, TOEFL exam ofcourse.
Then, he can apply to the 25 or so schools in the US that actually allow foriegn-trained dentists to get admitted into their 2nd or 3rd year (again depending on school) of DDS classes.

You need approved EAD. apart from waiting for 180 days. You also need I-140 APPROVED. If you have just recently applied for EAD (2 weeks ago) Do not expect it till atleast early April. It is taking them more than 90 days to approve EAD.
WAIT till you get EAD Approved AND I-140 Approved. Research about AC21 and how you can take advantage of that. Read up threads on AC21. It is going to be a longer wait than you thought.

Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

IMO, a new H-1B petition and new LCA is a safer option ... I had done this twice and it gave me peace of mind and flexibility to accept positions with better job prospects and pay... this was also recommended by the company lawyers and HR.

As your H1 extension is in process you can continue working until you get the approval notice. One you get the approval notice u will have the new I-94 with it which you can attach to the current one in passport and later point u can go for visa stamping.
